DMCA & Copyright Policy

Hudson Tribune ("we," "us," "our," or "Hudson Tribune") respects the intellectual property rights of others and expects users of https://hudsontribune.com/ (the "Site") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we have adopted the following policy for responding to claims of copyright infringement.

1. Our Commitment to Copyright

All original articles, images, graphics, and other content published on our Newsroom are either owned by Hudson Tribune, licensed for our use, or used under fair use principles with proper attribution. Details on how our content may be used are available in our Terms of Use.

2. Filing a DMCA Takedown Notice

If you believe that content appearing on the Site infringes your copyright, you may submit a written notice ("DMCA Notice") to our Designated Agent. To be effective, your notice must include the following, as required under 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material you claim is infringing, with enough detail (such as the specific URL) for us to locate it on the Site;
  • Your contact information, including your name, mailing address, telephone number, and email address;
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

2.1 Where to Send Your Notice

Incomplete notices may not receive a response. We recommend reviewing the requirements above carefully before submitting your claim.

3. Our Process Upon Receiving a Valid Notice

Upon receipt of a valid DMCA Notice, we will:

  • Review the notice for completeness and validity;
  • Remove or disable access to the allegedly infringing material in a timely manner, where warranted;
  • Notify the user or contributor responsible for the content, if applicable, of the removal and the reason for it;
  • Document the claim and our response for our internal records.

4. Counter-Notification

If you believe that content you submitted or that is attributed to you was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to dmca@hudsontribune.com. To be effective, your counter-notification must include, as required under 17 U.S.C. § 512(g)(3):

  • Your physical or electronic signature;
  • Identification of the material that was removed and its location on the Site before removal;
  • A statement, made under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification;
  • Your name, address, and telephone number;
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which Hudson Tribune may be found), and that you will accept service of process from the person who filed the original DMCA Notice, or an agent of such person.

Upon receipt of a valid counter-notification, we may reinstate the removed material within 10 to 14 business days, unless the original complainant informs us that they have filed a court action seeking a restraining order against the alleged infringer.

5. Repeat Infringers

In accordance with the DMCA and our policies, we reserve the right, in appropriate circumstances, to disable or terminate the accounts or access privileges of users, contributors, or commenters who are determined to be repeat infringers.

6. Misrepresentations

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees.

7. User-Submitted Content and Comments

This policy also applies to content submitted by users through comments, news tips, or other contributions, as governed by our User Content Policy. Contributors and freelance writers are additionally bound by the terms of our Contributor Agreement, which includes representations regarding originality and copyright ownership of submitted work.

9. Changes to This Policy

We may update this DMCA & Copyright Policy from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised policy.
